Abstrak

Mashlahah is often made identically with benefit. It has
placed in one of fields in Islamic law study, especially in
ushûl al-fiqh. It has a role in determining a debatable law
conclusion. It is also as essence of maqâshid al-syarî’ah that
is needed in every law consideration. The problem is
how to determine a law illah that has mashlahah, and who
has a role in determining and assessing mashlahah, only
God (syari’) or mukallafkah, if mukallaf has a right, how far
it has its power to determine a mashlahah in certain law
context. This writing will give its description.
